Below are assigned scenarios of incidents that highlight many of the ideas discussed tonight. Working with your assigned group, please read the prompt and then answer the questions that follow. You will only have 3 minutes to read, discuss, and decide. Please be prepared to share up to a 30 second response with the group.

2) If student rights were violated, and if so, how
3) Your group's decision regarding possible legal action. Be sure to cite EAA statute in your reasoning.




Discussion Point #1)

A well-known artist wants her 17 year-old child to initiate an art club at the local high school, which has over 15 functioning student-led clubs. The parent plans to attend all meetings to help supervise and run the club. The school administrator has reviewed the information regarding the club and found that it violates the rules established by the school and the Equal Access Act (EAA) and denies the student's request. The parent and student are both upset and plan to sue the school for violating their 1st amendment rights.


You Decide: Has there been a violation of rights? Explain. Do the mother and child have a case? Why or why not? Support your answer with points from the EAA and what you learned from the presentation.




Discussion Point #2)

A student at the local middle school wants to start a science club and has the support of his parents as well as a majority of the student body. He meets with the principal to explain his ideas and submit his formal request to use the school after school hours for club meetings. The principal explains to the student that she appreciates the student's desire to involve students in an after school activity, but cannot allow a the club to use the school for meetings, etc. The student leaves very upset. His parents encourage him to write a letter to the principal. He does, citing the Equal Access Act and its regulations. He notes that his club is directly related to the curriculum and claims that his 1st amendment rights have been violated.


You Decide: What if any rights have been violated? Does this student have any legal recourse with the administrator, school, or district? Support your answer with points from the EAA and what you know/have learned from this presentation.




Discussion Point #3)

The students of a hate group have approached their school administrator requesting use of the school for their group meetings. These students have noted that the school currently has a "limited open forum" which includes a religious club that holds regular bible study. Expecting resistance, the students pull out a copy of the Equal Access Act and show the principal that they have a right to use the building. They demand the use of the building, the PA system, and bulletin boards. The principal thanks them for their interest in an after school club and explains he is glad they have brought a copy of the Equal Access Act with them. He then proceeds to tell them his answer.
